Terms of Service
These Terms of Service govern your access to and use of our website, products, and development services.
1. Acceptance of Terms
By accessing or using any services provided by MassiveCoda.com ('we', 'our', 'us'), you agree to comply with and be bound by these Terms of Service. If you do not agree, please discontinue using our website and services immediately.
2. Scope of Services
We provide professional web design, web development, and related digital services. The scope of each project will be outlined in a written agreement or project proposal. Any additional work or feature requests beyond the agreed scope may incur additional fees.
3. Client Responsibilities
Clients must provide all necessary content, materials, and feedback in a timely manner to ensure project efficiency. Delays in client responses may impact delivery timelines and incur additional costs.
4. Payments and Invoicing
All fees are payable as outlined in the project proposal or invoice. Payment terms are typically 50% upfront and 50% upon project completion unless otherwise agreed in writing. Late payments may result in service suspension or project delay.
5. Intellectual Property
Upon full payment, clients retain ownership of the final deliverables, excluding proprietary frameworks, libraries, or development tools owned by MassiveCoda.com. We reserve the right to showcase completed projects for portfolio or marketing purposes unless otherwise agreed.
6. Confidentiality
Both parties agree to maintain confidentiality regarding all project-related and business information exchanged during collaboration, except where disclosure is required by law.
7. Limitation of Liability
We shall not be held liable for any indirect, incidental, or consequential damages resulting from the use of our services or website. Our total liability shall not exceed the total fees paid for the project.
8. Revisions and Maintenance
We provide a specified number of revisions as detailed in each project proposal. Ongoing maintenance, updates, or support beyond the initial project scope require a separate maintenance agreement.
9. Termination
Either party may terminate a project with written notice. Upon termination, the client shall pay for all work completed up to the termination date. All unpaid balances must be cleared before any deliverables are released.
10. Third-Party Services
Our services may involve integration with third-party platforms (e.g., hosting providers, APIs, plugins). We are not responsible for downtime, pricing changes, or limitations imposed by such third parties.
11. Privacy and Data Usage (GDPR Compliance)
We respect your privacy and complies fully with the EU General Data Protection Regulation (GDPR). We collect and process personal data only when necessary to provide our services, communicate with clients, and maintain project records.
Personal data may include your name, contact details, billing information, and communication records. We never sell or share your data with third parties except as required to deliver our contracted services or by legal obligation.
You have the right to access, correct, or request deletion of your personal data at any time. Requests may be submitted via our contact page.
All data is securely stored and processed within the European Economic Area (EEA), following industry-standard encryption and access control protocols.
